THIS ACTIVITY WAIVER FORM (this "Waiver")

IN CONSIDERATION of being allowed to participate in the Activity and other good and valuable consideration, the receipt of which is hereby acknowledged, I (the "Participant’s Representative") agree with Rebirth Martial Arts LLC (the "Activity Provider") for the Participant (the “Student”) to participate in the following: 

 Details of Activity

The Student will be participating in the following activity: Martial Arts Lessons and Services through Rebirth Martial Arts LLC (the "Activity") provided by the Activity Provider including the following:

• Teaching martial arts lessons and services including elements of Krav Maga, Karate, Competition Weapons in Martial Arts, Muay Thai Kickboxing, MMA, submission grappling, BJJ, and Taekwondo.;

• Providing self-defense seminars to children and adults, private groups and entities, or public groups and entities.;

• Giving privatized instruction of competition martial arts, self-defense, personal training, and individualized lessons catering to a students' needs.; and

• Providing catered events known as Parents' Night Out and Birthday Parties to watch and monitor children in our care while parents may be absent from the building.

• Contacting participant or participant's family about attendance and future attendance opportunities.

The Services will also include any other tasks which the Activity Provider, Participant’s Representative, and Student may agree on. The Servicer hereby agrees to provide such Services to the Student.

Consideration

Being of lawful age and in consideration of being permitted to participate in the Activity, the Participant’s Representative releases and forever discharges the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Student, which has been or may be sustained as a consequence of the Student’s participation in the Activity, and notwithstanding that such damage, loss, or injury may have been caused solely or partly by the negligence of the Activity Provider.

The Participant’s Representative understands that the Student would not be permitted to participate in the Activity unless the Participant’s Representative signed this Waiver.

Concurrent Release

The Participant’s Representative acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Student by the Activity Provider, and with the intention of binding the Student’s family, executors, administrators, legal representatives, and assigns.

Fitness to Participate

The Participant’s Representative acknowledges to the Activity Provider that the Student does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Student from participating in the Activity. If required, the Student will obtain a medical examination and clearance.

Full and Final Settlement

The Participant’s Representative acknowledges and agrees with the Activity Provider that: (1) the Activity Provider has given the Participant’s Representative sufficient time to carefully read this Waiver, (2) the Participant’s Representative has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver, (3) the Participant’s Representative fully understands the risks and claims that the Participant’s Representative is waiving to participate in the Activity, (4) the Participant’s Representative is freely and voluntarily executing this Waiver, and (5) the Participant’s Representative and Student is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Student may sustain while participating in or preparing for the Activity.

Governing Law

This Waiver will be governed by and construed in accordance with the laws of the State of Texas.

I agree with the terms listed above.

I grant permission for Rebirth Martial Arts to use photographs, videos, audio recordings, and/or textual material of me or my children for use in publications, including websites and social media outlets (collectively the “Media Material”), and to offer the Media Material for use or distribution in Rebirth Martial Arts communications or marketing materials without notifying me.

I hereby waive any right to inspect or approve the photographs, publications, or electronic matter that may be used in conjunction with the Media Material or other use of the Media Material now or in the future, whether that use is known or unknown to me, and I waive any right to royalties or other compensation arising from or related to the use of the Media Material.

I hereby agree to release and hold harmless Rebirth Martial Arts from and against any claims, damages, or liability arising from or related to the use of the Media Material, including but not limited to any re-use, distortion, blurring, alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in production of the finished product. It is the discretion of Rebirth Martial Arts to decide whether to use the Media Material. I understand that in order to opt-out, I must inform instructors that my child must not be visible in photos taken. I understand that if I opt-out, I must accept responsibility for communicating with staff and my student when pictures are being taken to remind them that my student is not allowed to participate.

  I have read this release before signing below and I fully understand the contents, meaning, and impact of this release.
